Liability Waiver — Pensioners Marathon 2026

1. Acknowledgement of risk

I acknowledge that participation in the Pensioners Marathon 2026 involves inherent risks, including but not limited to physical injury, illness, exhaustion, muscle strain, cardiovascular events, and in extreme cases, death. These risks exist regardless of the precautions taken by the organizers.

Road and traffic hazards along the course.
Adverse weather conditions including heat, rain, and wind.
Contact with other participants or spectators.
Uneven surfaces, potholes, and obstacles on the route.
Pre-existing or undisclosed medical conditions aggravated by exertion.

2. Medical fitness declaration

By registering for the Pensioners Marathon 2026, I declare that:

I am in good physical health and am medically fit to participate in my chosen race distance.
I have not been advised against strenuous physical activity by a medical professional.
I will seek medical advice before participating if I have any doubt about my fitness to do so.
I will immediately withdraw from the race and seek assistance if I feel unwell at any point.
I understand that pensioners and differently abled participants may be required to present medical clearance prior to race day.

3. Release of liability

In consideration of being permitted to participate in the Pensioners Marathon 2026, I, on behalf of myself and my heirs, executors, administrators, and assigns, hereby:

Release, waive, and discharge NAPSA, Lusaka Fitness Squad (LFS), Zambia Athletics (ZA), their officers, employees, volunteers, sponsors, and partners (collectively "the Organizers") from any and all liability, claims, demands, actions, or causes of action arising from my participation.
Indemnify and hold harmless the Organizers against any claims brought by third parties arising from my conduct or participation in the event.
Accept that this waiver applies to all forms of negligence by the Organizers, except where prohibited by Zambian law.

4. Emergency medical treatment

I authorize the Organizers and their appointed medical personnel to arrange or administer emergency medical treatment if I am incapacitated and unable to consent. I acknowledge that:

Medical support will be available at designated points along the course and at the finish line.
The Organizers are not responsible for the cost of any medical treatment, transport, or hospitalization arising from my participation.
I am responsible for carrying my own medical information and disclosing relevant conditions to race officials or medical personnel where necessary.

5. Property and personal belongings

The Organizers are not responsible for loss, theft, or damage to personal property before, during, or after the event.
Bag storage and any baggage-handling facilities are provided as a courtesy and are used entirely at the participant's own risk.

6. Event changes and cancellation

The Organizers reserve the right to modify, postpone, or cancel the event due to circumstances beyond their control, including force majeure events such as extreme weather, civil unrest, or public health emergencies.
In the event of cancellation, entry fees will not be refunded.
The Organizers are not liable for any costs incurred by participants as a result of changes to or cancellation of the event.

7. Minors

Participants under the age of 18 must have this waiver signed by a parent or legal guardian. By completing registration on behalf of a minor, the parent or guardian accepts all terms of this waiver and assumes full responsibility for the minor's participation.

8. Agreement and acceptance

By completing registration for the Pensioners Marathon 2026, I confirm that:

I have read and fully understood this Liability Waiver.
I voluntarily agree to its terms and accept all associated risks.
I am 18 years of age or older, or have obtained parental or guardian consent.
I understand this waiver is legally binding and affects my rights.

9. Governing law

This Liability Waiver is governed by and construed in accordance with the laws of the Republic of Zambia. Any disputes arising from this waiver shall be subject to the jurisdiction of Zambian courts.
